PLEASE CAREFULLY READ THESE TERMS AND CONDITIONS RELATED TO YOUR ACCESS TO, AND USE OF, THE WEBSITE OF THE HISTORIC THIRD WARD ASSOCIATION (HTWA). BY ACCESSING AND USING THE HTWA’S WEBSITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED BELOW, INCLUDING THE HTWA’S PRIVACY POLICY AND ALL OTHER TERMS OF USE INCORPORATED BY REFERENCE.
1. Scope of Terms and Conditions
These Terms and Conditions apply to your access to the HTWA’s website, which is operated by HTWA (the “Website”). These Terms and Conditions do not alter in any way the terms of any other agreement you may have with HTWA. HTWA expressly reserves the right to change, modify and/or eliminate these Terms and Conditions at any time and in its sole discretion. Any changes or modifications to these Terms and Conditions will be effective immediately upon HTWA’s posting of the modified Terms and Conditions on its website. You expressly and knowingly waive any rights you may have to receive specific notice of such changes or modifications. By accessing the HTWA’s website, you accept these Terms and Conditions and any changes or modifications in the future. For this reason, you should read these Terms and Conditions carefully and be sure you understand them. If you do not agree to these Terms and Conditions, you must stop accessing the website.
2. Privacy Policy
This Privacy Policy governs the way the HTWA collects, uses, maintains and discloses information collected from users (collectively “Users”) of our website: https://historicthirdward.org/ ("Website"). This Privacy Policy applies to the Website and all products and services offered by the HTWA.
a. What the HTWA May Collect. We may collect personally identifiable information from Users in a variety of ways, including without limitation when Users visit the HTWA Website, register on the Website, place an order, subscribe to any HTWA mailing list, respond to a survey, fill out a form, or interact with other activities, services, features, or resources the HTWA makes available on its Website. Users may be asked for, as appropriate, name, email address, mailing address, phone number and credit card information. Additionally, the HTWA may collect non-personally identifiable information about Users whenever they interact with the HTWA Website. This information may include the browser name, the type of computer or device used, technical information about Users' means of connection to our Website, such as the operating system and the Internet service provider utilized, and other similar information.
b. How the HTWA Uses Collected Information. We collect and use Users' personal information for the following purposes: (i) to improve customer service because information you provide helps the HTWA respond to your customer service requests and support needs more efficiently; (ii) to personalize each User’s experience because information in the aggregate that the HTWA collects helps us to understand how our Users as a group use the services and resources provided on the HTWA Website; (iii) to improve our Website as the HTWA continually strives to improve its Website offerings based on the information and feedback we receive from you; (iv) to process transactions where Users provide information about themselves when placing an order but then only to provide service to that order or to the extent necessary to enable outside parties to assist in providing that service; (v) to administer a content, promotion, survey or other Website feature whereby the HTWA will use the Users’ information they agreed to receive about topics we think will be of interest to them; and (vi) to send periodic emails to each User’s email address for updates pertaining to any orders made by the User on the Website or to otherwise respond to their inquiries, questions and/or other requests.
c. How the HTWA Protects Your Information. The HTWA has adopted and will continue to be vigilant in adopting appropriate data collection, storage and processing practices, as well as security measures, to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Website. Sensitive and private data exchange between the Website and its Users happens over an SSL-secured communication channel and is encrypted and protected with digital signatures.
d. Sharing of Your Personal Information. The HTWA does not sell, trade or rent Users' personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and Users with our business partners, trusted affiliates and advertisers for the purposes outlined above.

f. Changes to Policy and Acceptance of Terms. The HTWA has the discretion to update this Privacy Policy at any time. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically and become aware of modifications.
3. Cookies.
The HTWA may use “cookies” to track the use of its Website and to facilitate and enhance each User’s experience on the Website. Cookies are small pieces of information that are stored by the User’s browser on the User’s computer’s hard drive. The HTWA Website may use both cookies that we implement and cookies implemented by the HTWA’s suppliers and other third parties. 5. Third-Party Advertising Networks and Behavioral Advertising.
The HTWA contracts with service providers to serve advertisements on the HTWA’s behalf across the Internet and sometimes on this Website. The Website uses Google AdWords and Google Display Network, online advertising services provided by Google, and Facebook Tracking Pixel, an online advertising service provided by Facebook. They will collect anonymous information about each User’s visits to the HTWA Website and User interaction with the HTWA’s products and services. They may also use information about User visits to this and other websites to target advertisements for goods and services. These targeted advertisements may appear on the HTWA Website or on other sites that you visit. The anonymous information is collected using cookies, pixel tags, web beacons and other industry standard technology used by most major websites. 6. Dispute Resolution; Exclusive Jurisdiction and Venue.
The laws of the state of Wisconsin, regardless of any conflicts of law rules, govern these Terms and Conditions and your access and use of the HTWA’s Website. Your access and use may also be subject to other local, state, national or international laws. Any legal action brought concerning the Website shall be brought only in the state or federal courts located in Milwaukee County, state of Wisconsin (U.S.). Both parties agree to submit to the personal jurisdiction and venue of these courts and hereby expressly waive any challenges to such jurisdiction and venue.
7. User Circumvention.
Any attempt to circumvent or undermine the legitimate operation of the Website is a violation of criminal and civil laws. Should such an attempt be made, HTWA reserves the right to seek damages or other remedies from you and all other such person(s) responsible to the fullest extent permitted by law. Such attempts include, without limitation, using data mining, bots, web crawlers and setting up multiple accounts.
